Enforce your Debt Collection through CCJ High Court Enforcement
You have obtained a County Court Judgement (CCJ) and the Judge has ordered the debtor to pay you with immediate effect.......... but alas no payment is forthcoming, what are your options?
The Enforcement of payment of a CCJ is much the same as collection of any debt; with the added advantage that no-one apart from a Judge can tell you that it is not payable. A CCJ is an order which the debtor must pay, and as such we can use our considerable experience to appraise the debt and recommend the most appropriate action in our view to obtain a quick payment of the CCJ.
Our method of collection ensures that we use leverage in our negotiation to obtain payment as soon as possible. We first purchase the debt from you and as partners to the Equifax credit community we are able to submit information on your debtor’s indebtedness. Our leverage techniques are performed in the following ways depending on the circumstances of the debtor:
- Letter cycle informing of the negative information if we submit the CCJ to credit reference agencies
- Below £600 a County Court Bailiff will be instructed to levy distress on any luxury items
- Above £600 a High Court Bailiff will be instructed to levy distress on luxury items and business assets
- 3rd party order will be made to obtain payment from debtors of your debtor
- Levy distress on assets; Bailiffs, High Court Enforcement Officers can levy distress and remove certain assets until payment is obtained ,
- Attachment of earnings: arrange for attachment of earnings on weekly /monthly salaries
- Charging orders against freehold property
- Liquidation /Bankruptcy proceedings against the debtor
Typically we request an administration fee to engage our services, and of course, pass the Court costs directly to you in a quotation for you to approval before we execute the enforcement. This is the only cost apart from an agreed commission on collection of the debt. Any other costs which may be incurred are only incurred after you approval of a quotation. Additional costs may be direct costs like tracing fees or litigation fees if court action was required
