Counterclaim

A debtor can sometimes bring a claim against their creditor. 

In this case, they will need to serve Notice papers upon the party against whom they are bringing the charges, although both cases will be dealt with at the same time if it is taken to court.

No reply from debtor - Judgement by Default and then Enforcement       

If the debtor makes no response (no Acknowledgement of Service, no Admission and no Defence & Counterclaim),  then they are considered to have ‘defaulted’ and you, the creditor, will receive a Judge’s ruling by default
