Acknowledgement of Service

This is the first of the three forms constituting the Response Pack which is sent with the Notice of Issue by the Court to a debtor/defendant.

It allows the defendant to respond to the Courts that they acknowledge that a case has been brought against them.

From the date of the Notice of Issue, the defendant has 14 days to send the Acknowledgement of Service form back to the Court.

It must be noted that sending this form back is not an admission of guilt or liability.

The form allows the defendant another 14 days to either accept the charges in full or in part (Admission) or to deny/defend themselves (Defence and Counterclaim).

So, the defendant has 28 days in total to make known their position in regard to the contents of a Claim.

No reply from debtor-Judgement by Default and then Enforcement

If the debtor makes no response (no Acknowledgement of Service, no Admission and no Defence & Counterclaim),  then they are considered to have ‘defaulted’ and you, the creditor, will receive a Judge’s ruling by default

We are then able to enforce for you.

Please see our Enforcement section for more details.
